.co Colombia

Should you wish to register .co names with us or transfer .co names to our management, then the Registry Operator, .CO Internet S.A.S., imposes certain conditions. As set out in our agreement with you, by placing an order with us for a .CO domain name you unconditionally agree to be bound by Registry Rules, policies and procedures – including the .CO domain registration conditions as follows:

  • The requirements of the Colombian government as applicable to .CO registrants, from time to time
  • The Registry Operator’s policies and specifications including, without limitation, those set out on the .CO website(s) at https://www.cointernet.com.co/  and https://www.go.co/ as updated from time to time.
  • You agree to indemnify, defend and hold harmless Registry Operator, Com Laude and their respective affiliates and subsidiaries, as well as each of their respective owners, directors, managers, officers, employees, contractors, service providers and agents from and against any and all claims, damages, liabilities, costs and expenses, including reasonable legal fees and expenses (including on appeal), arising out of or relating in any way to your domain name registration, including, without limitation, the use, registration, extension, renewal, deletion, and/or transfer thereof and/or the violation of any applicable terms or conditions governing the registration. You agree to not enter into any settlement or compromise of any such indemnifiable claim without Com Laude’s prior written consent, which consent shall not be unreasonably withheld . Your indemnification obligation shall survive the termination or expiration of your agreement with Com Laude for any reason
  • If you are a reseller, you agree to indemnify, defend and hold harmless Registry Operator  and its affiliates and subsidiaries, as well as their respective owners, directors, managers, officers, employees, representatives, agents, service providers and contractors from and against any and all claims, damages, liabilities, costs and expenses of any kind, including without limitation reasonable legal fees and expenses (including on appeal), arising out of or relating to (a) any claim or alleged claim relating to any of your products or services; (b) any claim or alleged claim relating to any agreement with any end client that registers a domain name through you; (c) any claim or alleged claim relating to your domain name registration business or other activities, including, but not limited to, your advertising, domain name application process, systems and other processes, fees charged, billing practices and customer service; and/or (d) any breach by you of any of the terms, conditions, covenants, obligations, agreements, representations or warranties set forth herein. You shall not enter into any settlement or compromise of any such indemnifiable claim without Registry Operator’s prior written consent, which consent shall not be unreasonably withheld. This indemnification obligation shall survive any termination or expiration of your agreement with Com Laude.
  • You agree that any disputes, claims or controversies regarding the registration, ownership, use, transfer, assignment, loss, cancellation, or suspension of any .CO domain name or otherwise relating to the .CO TLD between:
    • you and Com Laude shall be governed by the laws of Colombia or the laws of the jurisdiction in which the principal office (or residence if you are an individual) or place of organization/incorporation of either Com Laude or where you are located. No other jurisdiction’s laws may govern; and
    • you and Registry Operator shall be governed exclusively by the laws of Colombia and that any such disputes, claims or controversies shall be brought and heard exclusively in the courts located in Bogotá, Colombia.
  • You certify that you have the authority to enter into your agreement with Com Laude; and will be responsible for any errors, falsifications or omissions of information.
  • You certify that neither the registration nor the use of the requested domain name interferes with or infringes upon the lawful rights of any person.
  • You agree that all official contact, correspondence and/or other information sent from or on behalf of Com Laude, Registry Operator or any other relevant official may be transmitted to the administrative contact information that appears in the registry database and that the designated administrative contact is authorised to receive all such communication and information.
  • You agree that the domain name may be suspended, terminated, cancelled or transferred in the interest of safeguarding compliance with Registry Operator’s security or registration policies or as a result of a dispute resolution.
  • You certify that the data provided in the domain name registration application is true, correct, up to date and complete and you will keep the information provided up to date. You further agree that registration and exclusive and perpetual right of use and enjoyment for any domain name may be cancelled if the Registry Operator or Com Laude determines that you have provided information that is incorrect, false or inaccurate either in the initial registration process or in any subsequent communications or in the event you violate any of the terms of your contract with Com Laude
  • You assume all responsibility and liability arising out of any assignment by you of a .CO domain name, including, without limitation, with respect to any users, clients, customers, licensees or other persons who may be using any sub-domain of the domain name or any website associated with the domain name.
  • You agree that neither Com Laude’s  acceptance of your registration request nor the actual registration of any domain name shall be deemed an indication that Registry Operator, Com Laude or the Colombian Government has made any determination regarding the legality of the registration, the extent to which your registration and exclusive and perpetual right of use and enjoyment of the domain name may violate any applicable laws, rules, regulations, policies, procedures, ordinances or decrees or infringe on the rights of any other person, and that neither Registry Operator, Com Laude nor the Colombian Government shall have any liability or responsibility arising therefrom.
  • You agree that the domain name has not been registered for and will not be used for any purpose that is fraudulent, illegitimate or otherwise in conflict with any applicable laws, rules, regulations, ordinances or decrees, including, without limitation for the submission of unsolicited bulk e-mail, phishing, pharming use of botnets or malware, infringement of the legitimate trademark rights of others, or any other abusive practices
  • You agree that the domain name will not be used for any illegal purposes, including without limitation, to:
    • Distribute malware or engage in malicious hacking, bot-netting, phishing, pharming, fast flux hosting, fraudulent or deceptive practices;
    • Use, promote, encourage the promotion of, or distribute child abuse images or engage in the exploitation of minors in any way;
    • Sell or distribute pharmaceuticals;
    • Infringe the intellectual property rights of any other person or entity including, without limitation, counterfeiting piracy or trademark or copyright infringement;
    • Impersonate any person or entity, or submit of information on behalf of any other person or entity, without their express prior written consent;
    • Violate the privacy or publicity rights of any other person or entity;
    • Promote or engage in any spam or other unsolicited bulk email;
    • Distribute software viruses or any other computer code, files or programs designed to interrupt, destroy, or limit the functionality of any computer software, hardware, or telecommunications equipment or computer or network hacking or cracking
  • You agree that all official contact, correspondence and/or other information sent from or on behalf of Registry Operator or any other relevant official will be transmitted to the administrative contact information that appears in the Registry Database and that the designated administrative contact is authorized to receive all such communication and information.
  • You agree that where the legal basis for processing the registrant’s personal data is consent, that the registrant has given its prior, express, and informed consent and authorization to the processing of their personal data in accordance with Com Laude’s and Registry Operator’s Privacy Policy.
  • You agree that where the legal basis for processing the registrant’s personal data is consent, that such registrant has given its prior, express and informed consent and authorization to Com Laude and Registry Operator to collect, store, use, share, process, transfer (including international transferring), market and/or disclose to third parties the following information, for the purpose of registration of the registrant’s domain name within the .CO TLD and, the Registry Database and Mirror Database/escrow File, the provisioning of the services in connection therewith, pursuant to Com Laude’s and the Registry Operator’s Privacy Policy, respectively, and to publish and otherwise disclose the following information in the WHOIS database and elsewhere:
    • Names, addresses, telephone numbers and email addresses of the registrant and registrant’s designated administrative contact.
    • Name, address, telephone number and email address of the registrant’s technical contact.
    • Dates related to the creation, last update and expiration of the domain name.

GoDaddy Registry’s Domain Name Locking Service

GoDaddy’s Registry Lock prevents changes to delegations at the registry level. Registry Lock may not be modified or removed from a Locked Domain Name absent the express written instruction from the relevant Registrar through processes set by Registry Services, LLC (RS LLC).

RS LLC’s terms and conditions require that Com Laude receive your consent in order to place locks on a domain name, or to modify or remove locks on locked domain names. RS LLC disclaims liability for the addition, modification or removal of any locked domain names absent specific instructions from the Registrar.

Under RS LLC’s terms and conditions, RS LLC must use commercially reasonable efforts to place Registry Lock on all proposed Domains submitted by Registrar no later than: (i) two (2) business days after RS LLC’s receipt of Registrar’s initial batch of proposed Locked Domain Names, and (ii) one business day after RS LLC’s receipt of proposed locked Domain Names from Registrar after the initial batch. In addition, RS LLC must use commercially reasonable efforts to modify or remove the lock from each Locked Domain Name by no later than one (1) business day following receipt of written instructions from the Registrar.

In addition to the reservation of rights set forth in the Registry-Registrar Agreement between Nom-IQ Limited trading as Com Laude, an ICANN-accredited registrar, and the registry operator of the .CO TLD, RS LLC reserves the right to add, deny, cancel or modify any lock that it deems necessary, in its discretion; (1) to protect the integrity and stability of the registry; (2) to prevent or mitigate phishing, pharming, malware, or other fraudulent, illegal or otherwise abusive purpose, in RS LLC’s sole discretion, (3) to comply with any applicable laws, government rules or requirements, requests of law enforcement, in compliance with any dispute resolution process; (4) to avoid any liability, civil or criminal, on the part of RS LLC, as well as its affiliates, subsidiaries, officers, directors, representatives, employees, and stockholders; (4) for violations of the Registry-Registrar Agreement or the Registry Lock™ Protocol; or (5) to correct mistakes made by Registry or Registrar.

RS LLC reserves the right to modify materially or discontinue the Registry Lock service upon sixty (60) days prior written notice to Registrars. Upgrades and enhancements to the Registry Lock service may be performed without notice to a Registrar. RS LLC has sole discretion to determine whether any change to the Registry Lock service is a material change which requires notice.
